BUSINESSES HAVE A DUTY TO PROTECT THE PUBLIC
Under California Law, owners and occupiers of property have a general duty to
protect the people who come on their property from dangerous conditions.
Usually, an owner can satisfy this duty by either fixing the dangerous condition or
warning people of its presence.  If the dangerous condition is obvious, however,
owners do not have a duty to warn.

A prime example of this duty is seen in a recent case where an older woman
entered into a gift store to buy a present for her daughter.  There was an
underground stairway hatch that was left open.  The entrance of the stairway
basically looked like a large hole in the ground and was hidden behind a display
case.  When the woman passed the display case, she fell into the open hatch,
falling a total of one story.  In this example the store owner had a clear duty to
protect customers from the dangerous condition, by closing the hatch or warning
people of its presence.
